1. Acceptance of terms

By accessing or using mapwinners.com and its services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.

2. Description of services

Map Winners provides local SEO and marketing services, including but not limited to:

Google Business Profile optimization
Posting on Google Business Profile
Website creation
Local citations
Generative Engine Optimization (AI search visibility)
Other features aimed at improving local search rankings

3. Client responsibilities

Provide accurate and complete information for all services.
Grant Map Winners access to necessary accounts and platforms, such as your Google Business Profile.
Pay all fees in a timely manner as outlined in the agreement.
Comply with all applicable laws and regulations related to your business and marketing practices.

4. Map Winners responsibilities

Perform services in a professional and timely manner.
Use industry best practices and ethical SEO strategies.
Maintain client confidentiality and protect sensitive information.
Provide regular reports and updates on progress.

5. Fees and payment

Fees for services will be outlined in a separate agreement.
Invoices are issued monthly and are due upon receipt.
Payments can be made via credit card or bank transfer.
Late payments may be subject to a late fee and may result in suspension of services.

6. Intellectual property

Map Winners retains ownership of all pre-existing intellectual property used in the creation of deliverables, including code, templates, and design elements.
The client receives a non-exclusive, non-transferable license to use final deliverables, such as website designs and reports, for their intended purpose.

7. Termination

Either party may terminate the agreement with 30 days written notice.

8. Limitation of liability

Map Winners will not be liable for any indirect, incidental, or consequential damages arising from the use of its services. The maximum liability for any claim will not exceed the total amount paid by the client for services in the 12 months preceding the claim.

9. Confidentiality

Both parties agree to keep confidential all information disclosed during the engagement, except as required by law.

10. Data protection

Map Winners is committed to protecting client data and complying with applicable data protection laws.
Client data will be collected, stored, and processed in accordance with our Privacy Policy.

11. Performance guarantee: we work for free until you rank

This section explains the guarantee referenced throughout our website.

Map Winners is dedicated to achieving the best possible results for our clients. Because SEO and online marketing depend on factors outside any provider's control, we cannot guarantee a specific timeline.
The guarantee applies after twelve (12) months of continuous service. If, at the end of that first year, the client's business is not ranking in the top 3 of the Google Map Pack for the target keywords and service area agreed at the start of the engagement, we continue working at no charge until those top positions are reached.
During any no-charge period the client is not invoiced for ongoing service. The engagement continues under the same agreed scope until the ranking targets are met. We do not stop at a fixed end date and we do not issue a further invoice to keep going.
Target keywords and service areas are agreed in writing at the start of the engagement, and results are measured against those agreed terms using our ranking and heatmap reporting.
This guarantee is conditional on the client fulfilling their responsibilities under Section 3, including timely access to required accounts, reasonable approval of recommended changes, and maintaining an active Google Business Profile that complies with Google's guidelines.
The guarantee does not apply where rankings are prevented by factors outside our control, including but not limited to profile suspension caused by the client, removal of our access, business closure or relocation, or changes to the agreed target keywords or service area.

12. Refund policy

In line with our performance guarantee, we do not offer monetary refunds.
If the agreed top 3 rankings have not been achieved after the first year, the client receives continued service at no charge until those positions are reached, rather than a refund.

13. Dispute resolution

Both parties agree to first attempt to resolve any dispute amicably through good faith negotiation.
If a resolution cannot be reached, the dispute will be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA) in Virginia.

14. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of the State of Virginia, United States.
Any disputes arising from these terms are subject to the exclusive jurisdiction of the courts in Roanoke, Virginia.

15. Modifications

Map Winners reserves the right to modify these Terms and Conditions at any time.
Continued use of services after modifications constitutes acceptance of the updated terms.
